We invite You to carefully read the present general terms and conditions of sale (the " GTC ") as well as the Terms of Use of the Site and the Personal Data Policy which govern Your navigation on the Site as well as our relations, if You Order Services related to the reservation and sale of a thermal cure, or a SPA skin care, or a gift card, offered by the La Roche Posay Thermal Centre.
Any Reservation or Order made on the Site implies the consultation and express acceptance of the GTC by ticking the box provided for this purpose during the Order or reservation process.
These GTC apply to the exclusion of all other conditions, in particular those applicable to sales in shops, or through other distribution or marketing channels.
In accordance with the applicable legal and regulatory provisions, it is reminded that the validation of the Order form as specified in these GTC constitutes an electronic contract between the Parties, which is proof between the Parties of the completeness of the Order, and of the due date of the sums owed in execution of said Order.

In accordance with article L. 223-2 of the French Consumer Code, you are reminded that you have the possibility of registering on a BLOCTEL (www.bloctel.gouv.fr) list of opposition to telephone cold calling to no longer be canvassed by a professional with whom You do not have a current contractual relationship.
1. Definitions
For the purposes of these GTC, it is agreed that "You" or the "Buyer" refers to the person browsing the Site and/or ordering Services on the Site; "We" or the "Seller" refers to the company identified in the legal notice above; the Buyer and the Seller shall be collectively referred to as the "Parties" and individually referred to as the "Party.
As used herein, each of the terms below shall have the meaning given in its definition, namely:
“Cure” or “Spa Treatment”: medical treatment offered by the Seller, based on a set of treatments using the natural mineral waters of the thermal springs of La Roche-Posay to the exclusion of any other service (hotel, catering, transport); a distinction is made between “agreed” Treatments, prescribed by a doctor (general practitioner or specialist) and which can therefore be partly covered by the compulsory reimbursement fund scheme, and “free” Treatments followed by the patient on their own initiative and therefore not covered by the compulsory reimbursement funds. Except where express reference is made to a "free" or "contracted" Treatment, the terms "Treatment" or "Spa Treatment" as used herein shall refer to both free and contracted Treatments.
"Subscriptions": refers to the services offered by the Seller to the Buyer on a recurring basis over a specific period and at specific times, resulting in the issuance of a personal access card.
"Beneficiary": refers to the Buyer or a third party as the beneficiary of the Services, depending on whether the Buyer uses the Services personally or offers them to a third party via a Gift Card.
"Gift Card": refers to the card that may be used by the Beneficiary to benefit from the Services ordered by the Buyer.
"Carré des Sources": refers to the aquatic area within the Spa consisting of a pool, hammam, sauna, and a fitness room.
"Order": refers to the sales contract entered into between the Seller and Buyer. Any Order is made with an obligation to purchase. The purpose of the Orders may consist of one or more Services and/or one or more Subscriptions.
"Order Confirmation": refers to the email sent to the Buyer once the deposit or full payment for the Services has been made.
"Reservation Confirmation": refers to the email sent to the Recipient once the Reservation has been made, indicating the day(s) and times for the Services to be provided.
"Use-by Date": refers to the date appearing on the Order Confirmation or on the Gift Card, indicating to the Recipient the deadline by which they can benefit from the Services.
"Reservation": refers to the day(s) and times on which the Buyer or Recipient and the Seller have agreed to provide the Services.
"Treatments": refers to the treatment services, either à la carte or grouped into a program, offered by the Seller and provided at the Spa.
"Spa" : refers to the entire Spa Source LA ROCHE POSAY complex, including the Carré des Sources and the areas where Treatments are performed.
"Patient": refers to the adult or minor natural person undergoing a Treatment offered by the Seller;
"Services": refers to the services offered by the La Roche Posay Thermal Center and related to the reservation and sale of a thermal treatment, a SPA treatment, or the purchase of a gift card.
"Internal Regulations": refers to all the operating rules of the La Roche Posay Thermal Center. To view the Internal Regulations applicable to Treatments or the Spa, click here.
2. BOOKING AND PURCHASE CONDITIONS
The Services We offer on the Site are reserved for individuals (i) of legal age (or minors with authorization from their legal representative allowing them to make a reservation and/or an Order on the Site) and (ii) with full legal capacity to place Orders and make reservations on the Site. We reserve the right at any time to request proof of identity from You attesting to your age and/or the authorization of the aforementioned legal representative. We reserve the right not to respond to an Order or reservation and/or to exclude from our customer/prospect database any Buyer who has not responded to the above request or who does not meet the requirements set out in this clause.
With regard to the Spa, it is specified that teenagers (12-18 years old) may only access the Spa by booking a Teen Treatment and must be accompanied by a parent. They do not benefit from separate
admission to the Carré des Sources.
Children under 12 are not allowed in the spa.
Pets are not allowed in the spa.
3. TERMS AND CONDITIONS FOR RESERVATION, VALIDATION AND RECEIPT OF THE ORDER
ON THE WEBSITE
To make a Reservation and place an Order online, the Buyer must first log in to the Site.
The Buyer then has the option to view the various Services offered for sale on the day of browsing the Site and to choose their Services by (i) browsing the different Service categories, (ii) entering the name of the Service directly into the search engine, or (iii) clicking on one of the pages in the Site map at the bottom of each page, thereby accessing the entire range of Services.
While browsing the Site, the Buyer wishing to make a reservation must complete the reservation form on the Site. Once this has been completed, the Buyer will see the number of Services in their shopping cart displayed.
We draw the Buyer's attention to the fact that the contents of the shopping cart may be subject to an expiration period. Once the selection of Services is complete, the Buyer can Order them by confirming the Order using the button provided for this purpose. The Buyer must log in to their personal account to finalize their Order.
A new page will then open, inviting the Buyer to:
- enter their username (email address) and password if the Buyer is already registered on the Site,
- accurately complete a personal data collection form by filling in the required fields.
The Buyer undertakes to complete the form provided in good faith. The Buyer acknowledges that the data they provide to the Seller and stored in the information systems of the Seller and/or its subcontractors are accurate and constitute proof of their identity. It is recalled that this personal data is governed by the Personal Data Policy, which can be accessed here.
After logging into their customer account and finalizing their shopping cart, the Buyer is invited to click on the button to proceed with the payment of their Order according to the terms and conditions set out in the "PAYMENTS" section of these Terms and Conditions.
By clicking on the button to proceed with the payment of the Order, the Buyer must first read these Terms and Conditions, and then confirm their agreement to all of the Terms and Conditions by performing the required confirmation action on the Website (for example, by checking a box).
Once the Buyer confirms their acceptance of the Terms and Conditions, a web page dedicated to the payment of the Order opens. All Orders are Orders with payment obligation, which means that placing an Order implies payment by the Buyer.
The Buyer must then proceed with the payment of their Order under the conditions described in these Terms and Conditions.
Please note that by choosing to pay by credit card, as provided in the "SERVICES – PRICES – PAYMENT" section below, the Buyer will be automatically transferred to the payment provider's electronic payment server. The payment provider's server is secured using SSL (Secure Socket Layer) encryption to protect all payment-related data as effectively as possible, and the Buyer's banking information will never pass through the Seller's computer system. The Buyer is therefore not liable.
The computerized records or any other data recorded by the Seller constitute proof of all transactions between the Seller and the Buyer.
Once the Order has been confirmed and payment validated according to the terms and conditions set out below, a printable and saveable summary of the Buyer's Order will be displayed, including the Order reference number. An Order confirmation email will be sent as soon as possible by the Seller to the email address provided by the Buyer and will include the following information:
- The Seller's identity and contact details,
- The Order reference number recorded at the time the Order was placed,
- A summary of the Order and the essential characteristics of the Services,
- Delivery times, costs, and any delivery restrictions,
- The total amount of the Order, including all taxes,
- The legal rights and guarantees available to the Buyer,
- Payment confirmation,
- These General Terms and Conditions of Sale,
- The withdrawal form.
It is expressly agreed between the Seller and the Buyer that emails are binding between the Parties, as are the automatic recording systems used on the Website, particularly with regard to the nature and date of the Order. The Buyer may access, where applicable in accordance with the rules of common law, the electronic contract concluded between the Buyer and the Seller. To do so, the Buyer should contact Cure Customer Service at [email protected] or Spa Customer Service at [email protected], providing all necessary information, including the Order number and contact details.
In all cases, the Seller reserves the right to refuse any Order for legitimate reasons, particularly in the event of suspected fraud. Similarly, any Order or payment that is irregular, ineffective, incomplete, or fraudulent for reasons attributable to the Buyer will result in the cancellation of the Service at the Buyer's expense, without prejudice to any civil or criminal action against the Buyer.
BY PHONE
For treatments, reservations made by phone at +33 5 49 19 49 49 will be accepted by the Seller from Monday to Friday, from 9:00 a.m. to 5:00 p.m.
For the Spa, reservations made by phone at +33 5 49 19 48 00 will be accepted from Monday to Sunday, from 9:30 a.m. to 6:30 p.m. The Buyer must pay by phone for the full amount of Services for a Gift Card or treatment according to the terms and conditions described below. The Buyer must pay by phone a deposit of 50% of the total amount of Services or the full amount of a Gift Card according to the terms and conditions described below.
Regardless of the Order method, contractual information will be confirmed by email according to the terms and conditions described below. The Order Confirmation will specify the name of the Service(s), the Order number, and the Order validity date. Printing and/or retaining this email will provide you with proof of your Order.
Any reservation or payment that is irregular, ineffective, incomplete, or fraudulent for reasons attributable to the Buyer will result in cancellation of the Order at the Buyer's expense, without prejudice to any civil or criminal action against the Buyer.
The computerized records stored in the Seller's or its subcontractors' computer systems will be considered proof of communication of reservations and payments between the parties.
a. SPECIFIC RESERVATION MODALITIES FOR A CURE
The Seller offers the reservation of Spa Treatments based on the condition to be treated. Each Treatment is described in detail on the Website.
The Buyer acknowledges having read the reservation terms and conditions, all the characteristics of the Treatment envisaged, and having, where applicable, requested and obtained the necessary and/or additional information to make their reservation with full knowledge of the facts. The Buyer is responsible for their choice and its suitability for their needs and, where applicable, for the prescription they received from their doctor.
At the time of reservation, the Buyer undertakes to provide accurate and truthful information regarding all questions asked and, where applicable, the appropriate supporting documents.
Regardless of the reservation method chosen by the Buyer, the Seller will notify the Buyer, subject to availability, of its acceptance of their reservation request within a maximum of 15 calendar days following the request. This confirmation will be made by sending an email and/or postal mail confirming the reservation and providing a detailed summary of the Treatment and the additional Services booked.
The Seller draws the Buyer's attention to the need to provide a primary email address and/or postal address that is valid and will remain so until the end of the Treatment.
Any communication sent by the Seller to this address is deemed to have been received and read by the Buyer, who therefore undertakes to regularly check messages received at this address and, if necessary, respond as soon as possible.
The Treatment booked, whether freely or by agreement, is non-transferable and non-assignable. It may not be assigned or transmitted to anyone.
b. Reservation termes and conditions
for a spa care or a gift card
The Seller offers Treatments for sale, either à la carte or bundled into a program, performed at the Spa.
To view the prices and details of the Treatments offered by the Seller, click here. When receiving the Treatment, the Beneficiary may also enjoy access to the Carré des Sources for a half-day or full day, depending on the Treatment program.
The Seller offers several Subscription offers for sale to the services available at the Spa.
To view the prices and details of the Subscription offers offered by the Seller, click here. Any changes to the Subscriptions sold by the Seller will be made to the subscriber's attention (closure during renovations, force majeure, etc.).
The Seller allows the Buyer to offer the Service(s) to a third-party Beneficiary via a Gift Card. The Gift Card will specify the name of the Services, the Order number, and the Use By Date. Gift Cards are valid for the Service(s) selected by the Buyer when placing their Order. Services must be completed within one year of purchasing the Gift Card.
The Seller reserves the right not to deliver the Service(s) to any person who has purchased their Gift Card outside the traditional distribution network, particularly directly from an individual.
The Buyer may, prior to placing their Order, review the essential characteristics of the Service(s) they wish to order, directly on the Website or by telephone. If the Buyer would like additional information or advice on the Services, they are invited to contact the Spa using the contact information provided below.
Once the Buyer has received their Order Confirmation or the Recipient of their Gift Card, they may reserve the day(s) and time(s) for the Services to be provided. Reservation of Services is mandatory. Due to the long Service Use Deadline, the content of the Services may be redefined and may not correspond exactly to that detailed in the Order Confirmation or Gift Card, without the Seller being liable in this regard.

The Reservation is confirmed by sending a Reservation Confirmation by email within 48 hours. This email must be retained as proof of the Reservation.
Teenagers (12-18 years old) may access the Spa by booking a Teen Treatment and must be accompanied by a parent. They do not have access to the Carré des Sources alone.
Children under 12 years old are not admitted to the Spa. Animals are not allowed in the Spa.
c. RECEIPT AND DELIVERY OF THE GIFT CARD
BY POST
The Gift Card is delivered to the postal address indicated by the Buyer when placing the Order. Once the Order has been prepared, it is sent to the postal address provided by the Buyer when placing the Order. The Gift Card is delivered by postal services or by a specialized service provider (depending on the case and/or the delivery options selected) (hereinafter the “Carrier”). In the event of the Buyer’s absence, the Carrier leaves a calling card in the Buyer’s mailbox. The Buyer must then contact the Carrier again to agree on a new delivery date. It is nevertheless specified that if the Buyer does not contact the Carrier again, the latter will make two new delivery attempts, the date and time of which will be determined at the Carrier’s discretion. In any event, the Gift Card Order will be executed within a maximum of thirty (30) days from the day following the day on which the Buyer validated their Gift Card Order, subject to full payment of the price and compliance with the purchasing conditions defined in the "Purchase Conditions" section of these General Terms and Conditions.
If delivery is not received within this period, the Buyer may cancel their Gift Card Order. In the event of a delivery delay (exceeding the indicated delivery time or, failing that, the maximum delivery time of thirty (30) days after validation of the Gift Card Order), the Buyer must, as soon as possible, notify the Seller of this delay by email by clicking here [Link to email address/Customer Service form to be inserted] so that the Seller can conduct an investigation with the Carrier. If the Order is found during this investigation, it will be immediately re-routed to the delivery location specified in the Gift Card Order. However, if the loss of the Order is confirmed at the end of this investigation, the Seller will, at its own expense, re-ship the Gift Card to the Buyer or, in the event of permanent unavailability, will refund the full amount paid by the Buyer (including delivery costs), depending on the payment method used.
In any event, in the event of a delivery delay of more than (10) business days from the Buyer's email reporting the delay, not due to force majeure, the Buyer may cancel their Gift Card Order by contacting Customer Service at [email protected].
If the Buyer exercises this right of cancellation, the price of the Order will not be collected by the Seller. In the event that payment for the Gift Card Order has already been collected, the Seller will refund the full amount paid by the Buyer (including delivery costs), using the payment method used, within a maximum of fourteen (14) days from receipt of the cancellation, excluding any other compensation.
Any anomaly/reservation identified at the time of delivery (including late delivery, missing or damaged products) must be fully and accurately reported by the Buyer on the receipt provided by the Carrier at the time the Services are made available and/or confirmed by registered letter to the Carrier within ten (10) days of receipt of the Gift Card Order by post.
Any such reservation must be notified in parallel and as soon as possible to the Seller's Customer Service at [email protected]. A copy of the complaint sent to the Carrier must be attached. The Seller shall not be held liable in any way whatsoever when the failure/delay in delivery of the Gift Card is attributable to the Buyer, i.e. either in the event of an input error by the Buyer when placing the Order, or in the event of the recipient being absent upon delivery of the Gift Card. The Seller shall not be held liable for any fault caused by the Carrier.
BY ELECTRONIC MEANS (E-GIFT CARD)
The Buyer may request that the Gift Card be sent by email in the form of an E-gift card to the email address indicated in his Order. The Seller shall not be held liable in any way in the event of a failure to send the E-gift card if this failure is attributable to the Buyer, i.e. in particular in the event of an error entering the recipient's email address by the Buyer when placing the Gift Card Order.
4. MODIFICATION AND CANCELLATION OF THE ORDER
a. Cures
Except for a cancellation made in accordance with the "RIGHT OF WITHDRAWAL" section herein, requests for changes to all or part of the Treatment must be submitted in writing (email, registered mail, fax, etc.) to the Seller at the following address: Thermes du Connétable, Rue du Docteur Benjamin Bord, 86270 La Roche-Posay, France. These requests are subject to the express prior consent of the Seller, who may, depending on the nature and scope of the changes, require the payment of an additional fee. However, no change request will be accepted less than 15 business days before the start of the Treatment.
In the event of late arrival or early departure of the patient during a voluntary Treatment, the full amount of the Treatment will remain due.
Cancellation requests must be submitted in writing to the Seller.
In the event that the Seller must cancel the Treatment, for any reason whatsoever, and without providing the patient with a reason, the Seller will not be entitled to any compensation. When the cancellation concerns one or more specific treatments within the Treatment, the Seller will offer the patient, in cases where the cancellation is not justified by the patient's state of health, a rescheduling of these treatments during the duration of the Treatment.
Any reimbursement made by the Seller, regardless of the reason, will be made by bank transfer, after the Buyer has provided their bank details.
b. Skin care - gift card
Any request to cancel or modify a Reservation must be made no later than 72 hours before the start of the reserved Service.
Unless otherwise duly justified by a medical certificate, any cancellation or modification after this 72-hour period will result in the payment of compensation equal to 50% of the price of the Service.
Regarding Gift Cards, no cancellation or modification of the Reservation will be permitted after this 72-hour period. In the event of a no-show by the Beneficiary for the appointment set in the
Reservation, the Gift Card will be considered permanently lost and will not be refunded or credited. If the Beneficiary requests more than two cancellations or modifications to the Reservation (in advance of more than 72 hours), the Seller will be entitled to charge an administrative fee of €40. Services may be provided until the Use By Date indicated in the Order Confirmation or on the Gift Card. If the Services are not provided before this date, the Recipient will no longer be able to benefit from the Services and will not be entitled to a refund.
In the event that the Seller must cancel the Reservation, particularly in the event of unavailability, the Buyer will be reimbursed for the full amount paid when placing the Order.
5. SERVICES - PRICES - PAYMENTS
a. Services
The Services offered for sale on the Site are those which appear on the Site on the day the Buyer consults the Site.
The Buyer is informed that the photographs and texts illustrating the Services are subject to change.
b. Prices
The prices communicated by the Seller are inclusive of all charges.
Prices are indicated in euros (€). They take into account any discounts and VAT applicable on the day of the Order. Any change in the applicable VAT rate will be reflected in the price of the Services.
The prices of approved packages according to different therapeutic orientations and medical prescriptions are provided for informational purposes only and remain subject to legal or contractual changes, in particular from the National Health Insurance Fund (Caisse Nationale d'Assurance Maladie).
It is specified that any promotions granted in the form of discount vouchers are only valid for a single Order per household and for a given validity period and cannot be combined with other discount offers.
The Seller reserves the right to modify its prices at any time. Services are invoiced based on the prices in effect at the time the Order is placed.
c. Methods of payments
The amount owed by the Buyer is the amount indicated on the Order Confirmation as displayed on the dedicated website page and subsequently sent by email by the Seller to the Buyer.
The Buyer has the choice of different payment methods when confirming their Order as specified above.
Payment can be made:
• at the time of the Order, online, by credit card (Visa, Amex, Mastercard) or via PayPal;
• by telephone, from 9:30 a.m. to 6:30 p.m., Monday to Sunday, at the cost of a local call, by credit card (Visa, Amex, Mastercard);
• in cash at the Spa reception, up to a limit of €1,000. • By check and holiday vouchers for the payment of Services related to a Treatment or for the purchase of a gift card by presenting yourself at the Spa reception, or by sending the checks by registered letter with acknowledgment of receipt to the following postal address:

The Reservation can only be made once the checks/holiday vouchers have been cashed by the Seller.
The Order is only validated by the Seller after (i) acceptance of the General Terms and Conditions by the Buyer, (ii) verification and confirmation of the validity of the payment, and (iii) sending the Buyer confirmation of acceptance of their Order. In any event, the Seller reserves the right to refuse any Order or any delivery in the event of (i) an existing dispute with the Buyer, (ii) total or partial non-payment of a previous Order by the Buyer, (iii) refusal of authorization of payment by bank card by banking organizations, (iv) non-payment or partial payment.
d. Payment conditions for a spa care
A deposit of 50% is paid on the day of the Order, in accordance with the terms and conditions specified above.
The Purchaser must pay the balance of the amount, at the Spa reception, on the day of the execution of the Services.
e- Payment conditions for a gift card
The price is paid in full on the day of the Order, according to the terms and conditions specified above.
f. Terms of payment for subscriptions
The price of a Subscription is paid in cash on the day of subscription. The Subscription is taken out for a fixed period. Consequently, the subscriber is firmly and definitively committed for the entire duration of the Subscription and will not be entitled to any reimbursement, except in the case of a definitive contraindication justified by a medical certificate concerning the Services covered by the Subscription (reimbursement on a pro rata basis). In the event of temporary contraindication justified by a medical certificate, the Subscription may be extended at the request of the subscriber. In any event, payments made by the Buyer will only be considered final after the effective collection of all sums due.
g- Conditions of payment for a cure
Contracted Treatment: The patient must provide the Seller with the original copy of their thermal package coverage on the day of arrival for the treatment. It is reminded that the cost of the Treatment is partially or fully covered by healthcare organizations and, where applicable, by mutual insurance companies, depending on the contract.
Unrestricted Treatment: A quote will be prepared in duplicate at the patient's request. It is reminded that unrestricted Treatments are not covered by healthcare organizations or mutual insurance companies, and are therefore subject to full payment by the Buyer.
The cost of the Treatment (unrestricted or contracted), or the co-payment if the Buyer benefits from third-party payment, must be paid by the patient at the administrative appointment scheduled upon arrival for the Treatment, by check, credit card, or cash, up to a maximum of €1,000.
At the end of the treatment (agreed or voluntary), an invoice is given on Saturday by the medical assistants.
h- Fight against fraud
In order to protect the Seller from fraudulent practices, and in the event that the Seller or the online payment service provider suspects that an Order is fraudulent, they reserve the right to ask the Buyer (prior to processing the Order) for additional documents (in particular proof of the Buyer's identity) in order to verify that the Order is not fraudulent.
If the Buyer fails to respond within fifteen (15) days of the request being sent by the Seller or the online payment service provider, the Order shall be cancelled and no payment shall be collected by the Seller. In the event that payment for the Order has already been received, the Seller shall proceed to reimburse the Order within fourteen (14) days of the expiry of the aforementioned period, depending on the payment method used by the Buyer.
6. RIGHT OF WITHDRAWAL
In accordance with European and national regulations, and in particular the provisions of Article L. 221-18 of the French Consumer Code, applicable to contracts concluded remotely and off-premises, the Buyer who places an Order on the Website or by telephone has the right to withdraw, without penalty, within fourteen (14) business days of the Order Confirmation.
If this period expires on a Saturday, Sunday, or public holiday, it will be extended until the next business day.

If the Buyer has paid a deposit, the Buyer will be reimbursed no later than fourteen days from the date on which they informed the Seller of their decision to withdraw. No request for withdrawal will be taken into account after the withdrawal period has expired; the Buyer may, however, cancel the Order under the conditions set out in the article “MODIFICATION AND CANCELLATION OF THE ORDER” above.
7. GARANTIES AND RESPONSABILITIES
a. Cures
The Services offered comply with current French law. The Seller shall not be held liable for non-compliance with the legislation of a third country.
The Seller is bound by a general obligation of means in the provision of the care and services included in the selected Service(s), consisting of the implementation of all due diligence necessary to provide the Services.
The Seller shall not be held liable to the Buyer for failure to fulfill its obligations in the event of the occurrence of an event constituting force majeure, as defined by Article 1218 of the French Civil Code and by relevant French case law, and making it impossible to maintain a Reservation. Complaints of a commercial nature or relating to a lack of conformity must be sent to the Seller by registered letter with acknowledgment of receipt to the contact details provided in the "MEDIATION" section of this Agreement, as soon as the Buyer becomes aware or should have become aware of the facts that are the subject of their complaint, and within the legal limitation period.
The Seller strives to provide the Buyer with the most reliable and high-quality information possible regarding the Services on the Website. The photographs, visuals, and illustrations reproduced and illustrating the Treatments are presented for informational purposes only.
b. Spa care - gift card
The Services offered comply with current French legislation. The Seller shall not be held liable in the event of non-conformity with the legislation of a third country.
The Seller is bound by a general obligation of means in the provision of the skin care and services included in the selected Service(s), consisting in the implementation of all the necessary diligence for the provision of the Services.
The Seller shall not be held liable to the Buyer in the event of non-performance of its obligations in the event of the occurrence of an event presenting the characteristics of force majeure, as defined by article 1218 of the French Civil Code and by French case law on the subject, and making it impossible to maintain a Booking.
Complaints of a commercial nature or relating to a lack of conformity must be sent to the Seller by registered post with acknowledgement of receipt to the address given in the "MEDIATION" section of these Conditions, as soon as the Buyer is aware or should have been aware of the facts which are the subject of the complaint, and within the legal limitation period.
The Seller endeavours to treat the Buyer, on the Site, with the most reliable and qualitative information available concerning the Services. The photographs, visuals and illustrations reproduced and illustrating the Treatments are presented for information purposes only.
c. Garanties and responsabilities

8. HYGIENE - INTERNAL REGULATIONS - ACCESS TO THE SPA

By making a Reservation, the Buyer undertakes to comply with the hygiene and other rules applicable within the spa establishment. These rules are set out in the Internal Regulations. Patients can request the Internal Regulations at reception.

The Beneficiary declares that they have read the Spa's Internal Regulations, available on the Website and posted at the Spa. In any event, the Beneficiary agrees to comply with the Internal Regulations.
The Treatments provided at the Spa are wellness treatments, with no therapeutic or medical purpose.
However, certain medical conditions may be incompatible with using the Spa and/or receiving certain Treatments, including: circulatory disorders, respiratory or cardiac disorders, diabetes, kidney problems, epilepsy, high or low blood pressure.
If in doubt, consult your doctor and, if necessary, request a certificate of non-contraindication.
Furthermore, certain treatments or programs are not suitable for pregnant women (consult us and your doctor before booking).
Access to the Spa is subject to the signing of a welcome document, in which the Beneficiary acknowledges that they have no medical contraindications to using the Spa and/or receiving the requested Treatments.
c. Conditions of access to the spa
Once the Reservation of Services has been made, the conditions of access to the Spa are notified in the internal regulations of Spa Source which can be viewed here.

9. MEDIATION

After completing this process with Customer Service, and in the event of a complaint not resolved by our Customer Service, you may contact a mediator free of charge in accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes. The Seller subscribes to the services of the following mediators:

This remedy excludes approved spa treatments, which are services provided on medical prescription and are governed by the Public Health Code and the Social Security Code, not the Consumer Code.

At European level, the Online Dispute Resolution platform, in accordance with Article 14 of Regulation (EU) No. 524/2013, can be used for any consumer dispute and is accessible via the following link: https://webgate.ec.europa.eu/odr/.
10. MISCELLANEOUS PROVISIONS
a. Force majeure
Neither Party shall be liable for the total or partial non-performance of its obligations under these General Terms and Conditions if such non-performance is caused by an event constituting force majeure.
Force majeure is defined as an event meeting the criteria set by the case law of the Court of Cassation and applicable law.
The Party invoking an event constituting force majeure must notify the other Party within five (5) business days of the occurrence of the event. The Parties agree to consult as soon as possible to jointly determine the terms and conditions for executing the Order for the duration of the force majeure event. After a period of one (1) month of interruption due to force majeure, the Seller may not fulfill the Order, and it shall be responsible for reimbursing the Buyer, if applicable.
B.Partial invalidity
If one or more of the provisions of these GTCs are held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent court, the other provisions shall retain their full force and scope.
c. Completeness of the CGV
These GTC and the Order summary sent to the Buyer form a contractual whole and constitute the entire contractual relationship between the Parties.
In the event of contradiction between these documents, the GTC shall prevail.
It is specified that the Buyer may save or print out these GTC, provided that they are not modified.
The current GTC can be consulted at any time under the heading "General Terms and Conditions of Sale" accessible via all pages of the Site.
The Seller may update these GTC at any time. Any such update shall be subject to prior and specific notification on the Site.
e- Non-waiver
The fact that one or other of the Parties does not avail itself at a given time of any of the stipulations of the present Terms and Conditions shall never be considered as a waiver on its part of the rights it holds from the latter.
f- Application law and competent jurisdictions
These GTC and the contractual relations between the Buyer and the Seller are subject to French law.
In the event of a dispute between the Buyer and the Seller, and if the dispute is not resolved through the mediation provided for in the "MEDIATION" article above, it will be brought before the competent French courts. The parties agree to meet and try to find an amicable solution to their dispute, prior to bringing the matter before the competent jurisdiction.
